Afolabi Olaoye and Makinde
A high court in Ogbomoso has restrained the Oyo state governor, Engr Seyi Makinde, and eleven others from presenting any instrument of office in any form of ceremony or issuance of certificate of installation to Pastor Afolabi Ghandi Oladunni Olaoye as the new Soun of Ogbomoso land.
Justice K.A Adedokun gave the order on Thursday while ruling on a motion ex-parte filed by one of the contenders for the Soun of Ogbomoso stool, Prince Muhammed Kabir Olaoye.
Governor Makinde had approved the appointment of a pastor of the Redeemed Christian Church of God, Afolabi Olaoye, as the new Soun of Ogbomoso.
Last year, the selection of a new monarch nosedived into a legal battle as the chairman of the screening committee for Laoye Ruling House in Ogbomoso, Abdulwahab Laoye, said the family had not selected anybody to fill the vacant stool.
However, on Saturday, a statement by the commissioner for local government and chieftaincy matters, Olusegun Olayiwola, said the announcement followed the long-drawn processes specified under the law.
Justice Adedokun in the judgement on Thursday also gave an order restraining Pastor Afolabi Ghandi Olaoye from parading, representing, or presenting himself as the candidate for any ceremony for the issuance of a certificate of installation or wearing any regalia resembling that of the occupant of the stool of Soun of Ogbomoso Chieftaincy pending the hearing and final determination of the mandatory injunction already filed before the court.
He also ordered Prince Muhammed Kabir Olaoye to serve the motion on notice for mandatory injunction on all the 12 respondents in the suit.
In giving the order, Justice Adedokun stated that after hearing Abiodun Ogunjinmi, counsel to Prince Muhammed Kabir Olaoye, who moved motion ex-parte before the court and after carefully perusing the application, the affidavit in support, the affidavit of urgency, which are the three exhibits attached as well as the written address, he is convinced the application has merit.
“I am convinced that the application is one of the instances where this honourable court is empowered by Order 48 Rule 8 to exercise its discretion in favour of grant of same. One of the situations which an injunction is designed to combat is to arrest a fiat accompli which the 1st, 2nd, 3rd and 12th respondents have attempted to foist on the circumstances of this case. In this situation, the application is ordered as prayed and accordingly,” Justice Adedokun held.
He consequently adjourned the matter to September 12, 2023 for hearing of the application.
Other respondents in the suit are Ogbomoso North traditional council, Prince Amos Olaoye, the Mogaji of Olaoye Ruling House; Chief S.O. Otolorin, the Areago of Ogbomoso land, who is also the chairman of the kingmakers of Soun Chieftaincy; Chief Salawu Ajadi, the Jagun of Ogbomoso land; Chief Tijani Abioye, the Baara of Ogbomoso land; Chief David Adeniran Ojo, the Ikolaba of Ogbomoso land and Chief Yusuf Rasaki Oladipupo, the Abese of Ogbomoso land.
